When you have CCTV installed in a domestic property there do’s and don’ts you need to know about to ensure you are also protected from the law. You must always respect other peoples privacy so in this blog, we have outlined the main items you need to know before installing CCTV to your premises.
If your cameras are set up so that they only capture activity within in the grounds of your property, including your garden, the data protection laws will not apply to you. However, if you CCTV system does reach the outside of the boundary such as your next door neighbours garden or shared public spaces then you will need to know about the data protection act and you must comply with the laws.
What is meant by ‘private domestic property’?
Private domestic property means the boundary of your property, including the garden, of where you live.
How to use CCTV responsibly and in the correct way
What areas do you need the cameras in? can you position the cameras correctly so they don’t cover your neighbours property or outside your boundary? These are both things you need to consider. If for whatever reason your cameras to capture activity outside of your boundary it does not mean you are breaking the law. It just means that you are the CCTV controller so you will need to comply with legal obligations under the data protection act.
If you are capturing people outside of your properties boundaries then you must have a justifiable reason for doing so. Why do you need those images? What is the purpose of them? You will need to ensure people are aware that you have cameras up using the appropriate signage and that you don’t capture any more footage than you need.
The footage you take bust be kept private and secure so that nobody else can watch it without good reason. Once you no longer need the footage we recommend that you delete it.
